It protects the human rights given by the Constitution like the right to life, right to liberty and right to equality etc.<\/p>\n\n\n\n<p>There is a platform to deal with human rights violations by constituting a National Human Rights Commission and providing for the <strong>Constitution of State Human Rights Commissions<\/strong>. The statute under which it is established is the <strong>Protection of Human Rights Act (<\/strong>PHRA<strong>), 1993<\/strong>, as amended by the <strong>Protection of Human Rights (<\/strong>Amendment<strong>) Act<\/strong>.<\/p>\n\n\n\n<div class=\"wp-block-buttons is-content-justification-center is-layout-flex wp-container-core-buttons-is-layout-16018d1d wp-block-buttons-is-layout-flex\">\n<div class=\"wp-block-button has-custom-width wp-block-button__width-100\"><a class=\"wp-block-button__link has-text-align-center wp-element-button\" href=\"https:\/\/khanglobalstudies.com\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>\ud83d\ude80 Click here to get more information about other government exams\ud83d\udcd6 like UPSC, SSC, Defence, Police, Banking etc.<\/strong><\/a><\/div>\n<\/div>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>History of the Human Rights Commission<\/strong><\/h2>\n\n\n\n<p>The history of the Human Rights Commission is as follows:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>In 1948 the United Nations adopted the Declaration of Human Rights.<\/li>\n\n\n\n<li>The Paris Principles were established by the National Human Rights Institutes (NHRIs) in 1991.<\/li>\n\n\n\n<li>The United Nations adopted these Paris Principles at its General Assembly in 1993.<\/li>\n\n\n\n<li>In 1993, India enacted the Human Rights Protection Act.<\/li>\n\n\n\n<li>This resulted in the formation of the National Human Rights Commission (NHRC).<\/li>\n\n\n\n<li>The Protection of Human Rights Act also allowed state governments to establish State Human Rights Commissions.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>NHRC Member<\/strong><\/h2>\n\n\n\n<p>The <a href=\"https:\/\/nhrc.nic.in\/\" target=\"_blank\" rel=\"noreferrer noopener\">National Human Rights Commission<\/a> (NHRC) is the central human rights body of India. There are a total of <strong>6 members<\/strong> \u2013 <strong>a Chairman and five Members<\/strong>. The Chairman of the Commission should be a retired Chief Justice of India. <strong>Justice Shri Arun Kumar Mishra<\/strong> is currently the Chairman of the NHRC.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Functions and Powers of the Human Rights Commission<\/strong><\/h3>\n\n\n\n<p>The functions and powers of the Farmers Rights Commission are as follows:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>If any matter related to the violation of human rights comes to the notice of NHRC, then NHRC is empowered to investigate it.<\/li>\n\n\n\n<li>It has the right to intervene in all judicial cases related to human rights violations.<\/li>\n\n\n\n<li>The Human Rights Commission has all the same powers as a civil court and can deal with cases similar to it.<\/li>\n\n\n\n<li>It is authorized to investigate any central or state-level officer when there is a complaint.<\/li>\n\n\n\n<li>It can look into a case only within a year of its occurrence. It is not within his jurisdiction to take action after more than a year has passed.<\/li>\n\n\n\n<li>Its functions are mainly of recommendation type.<\/li>\n\n\n\n<li>His powers regarding the army are limited.<\/li>\n\n\n\n<li>It has no authority to take action regarding human rights violations by any private entity.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>What are the limitations of NHRC?<\/strong><\/h3>\n\n\n\n<p>The boundaries of NHRC are stated as follows:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The recommendations made by the NHRC are not binding.<\/li>\n\n\n\n<li>Human rights violations by private parties cannot be considered under NHRC jurisdiction.<\/li>\n\n\n\n<li>The NHRC does not have the power to punish officials who do not implement its recommended orders.<\/li>\n\n\n\n<li>NHRC does not have any special mechanism for investigation.
